Article 2 – Scope and Conditions
Our general terms and conditions apply to all offers made to you as an end user, i.e., an individual purchasing or using products or services exclusively for non-professional purposes (hereinafter referred to as "you" or "your").
We deliver exclusively in the BENELUX and reserve the right to refuse delivery to an address outside of BENELUX.
To place an order, you must be at least 18 years old. If you are under 18, please have your parent or legal guardian place the order. We reserve the right to refuse orders we identify as being placed by minors.
If additional specific conditions apply alongside these general terms and conditions, the preceding provisions also apply to these specific conditions. In the event of any conflict between our general and specific conditions, the latter shall prevail.
Placing an online order implies your prior consultation and explicit acceptance of our general terms and conditions of sale. These are always available on the Website. No order can be validated without ticking the box acknowledging the acceptance of the terms and conditions.
Article 3 – Offer and Order
If an offer is valid only for a limited time or is subject to specific conditions, we will explicitly indicate this in the offer.
Product Availability: Products available for sale are listed on the Website at the time of your consultation. We commit to fulfilling your orders to the best of our ability but cannot be held liable for damages arising from product unavailability. If an unavailable product is part of a confirmed order, you will be informed via email or phone about the full or partial cancellation of your order. If the payment has already been debited, a refund will be issued promptly.
We strive to accurately describe our products, promotions, and order process in good faith. However, the images on our Website are not contractually binding. We disclaim responsibility for errors in product descriptions or the ordering process but will correct such errors promptly upon notification.
If the delivered product does not match the delivery note, it can be returned as specified in Article 7.4.
To purchase a product:
- Add it to your cart.
- Enter your contact and billing information.
- Choose your delivery method.
- On the summary page, accept the terms and confirm your payment by clicking the order button.
Your purchase is finalized once these steps are completed. A confirmation email will follow, and you can track your order status through your account or the confirmation email.
Article 4 – Price
We reserve the right to modify our prices at any time. However, products are invoiced based on the price applicable at the time of your order.
Prices on the Website are in euros and include VAT, administrative fees, and other services unless stated otherwise. Delivery and logistical fees, if applicable, are clearly stated during the order process and included in the total price.
Article 5 – Payment
Payments can only be made via the payment modules provided on the Website. Accepted methods include:
- Visa
- MasterCard
- Apple Pay
- Maestro
- Bancontact
A transaction is considered complete, and the contract finalized, only when the card issuer approves the payment. We are not liable for delivery delays or failures due to the card issuer's refusal to process your payment. Orders without valid payment details will not be accepted.
We reserve the right to cancel or refuse any order or delivery in case of an existing dispute.
To ensure online payment security, transaction data is encrypted using SSL technology. A secure SSL connection is indicated by a "lock" icon in the status bar of your browser.
Article 6 – Delivery and Execution
All products are delivered to the address specified during the online order, based on the provided instructions. You are responsible for the accuracy of the information supplied, and we are not liable for issues caused by incorrect data. Products are delivered only within Belgium, excluding P.O. boxes.

Delivery Times:
- Stocked items: Delivered within 1 to 5 business days.
- Out-of-stock items: Not delivered, and payment will be refunded promptly.
Risk of loss, theft, or damage passes to you upon delivery.
You will receive a tracking number via email when your order is dispatched, along with your invoice. Deliveries will include a packing slip detailing the delivered products.
If no one is available to receive the package, a notice will be left with instructions for retrieval or redelivery.
We are not liable for indirect damages due to delayed or failed delivery by the carrier. Our liability is limited to the value of undelivered products within the stipulated time frame.
On the day the package leaves the warehouse, you will receive an email with a Track & Trace number allowing you to track your package online. You will also receive an email with the invoice for your order. The invoice will include details of the delivery and VAT charges. Delivery will be accompanied by a delivery note listing the delivered products.
Your order will be presented to you or any other person present at the delivery address. We cannot be held responsible for any damages of any kind that may result from your order being received by another person at the delivery address. If no one is available to receive your order at the time of delivery, a notice will be left. This notice will contain the postal address where you can collect your products and a phone number to arrange a delivery time with the carrier. Your products will be available for 15 days after the delivery attempt. After this period, the products will be returned to us. In this case, you can contact us to arrange a new delivery at your expense.
We cannot be held liable for any indirect damage caused by late delivery or non-delivery by the carrier. In such cases, our liability is limited to the value of the products for which non-receipt within the time frame specified in Article 6.4 is proven.
Article 7 - Compliance
You have a legal warranty of 2 years on goods purchased from us. This warranty only covers a pre-existing non-conformity defect at the time of delivery. During this period, we commit to replacing or repairing the product free of charge. We reserve the right to exchange the product if repair is impossible or disproportionate. Unless proven otherwise, any non-conformity that appears within six months of delivery is presumed to have existed at the time of delivery, unless this presumption is incompatible with the nature of the product or the defect. Defects appearing after six months are presumed not to have been present at the time of delivery unless proven otherwise. For more information regarding the legal warranty, please refer to Article 8 – Legal Warranty.
To invoke a warranty, you must provide proof of purchase, the order confirmation, or the invoice. The warranty is non-transferable. Any defect must be reported to our Customer Service within 2 months of its discovery. After this period, all rights to repair or replacement expire. Our Customer Service will guide you through the process of returning the products. Any return of products will only occur following our prior written confirmation.
You must verify that the quality and quantity of the delivered products match your order. Any complaint about apparent defects or missing products must be communicated to our Customer Service via email no later than 5 days after delivery, without prejudice to the right of withdrawal. Failure to do so within this timeframe results in the loss of the right to make claims regarding apparent defects or missing products. Complaints about defects will only be considered valid if the products have not been used or otherwise damaged. Our Customer Service will guide you on how to return the products. Any return of products will only occur following our prior written confirmation.
If a delivered product does not match your order and provided the procedure in Article 7.2 is followed, we commit to replacing the product. If replacement is impossible or disproportionate, we will refund all payments received, including delivery charges if applicable. If a voucher was used for the order, the net amount (i.e., the purchase price minus the voucher amount) will be refunded. Upon your explicit request to our Customer Service, a new voucher will be issued for future use.
The commercial and/or legal warranty does not apply to defects caused by accidents, product deterioration due to negligence, falls, improper use of the product contrary to its intended purpose, failure to follow instructions, modifications or adaptations to the product, misuse, abnormal, commercial, or incorrect use. It also does not apply to short-lived products or cases where a third party not designated by us intervenes.
Article 8 - Legal Warranty
The legal warranty corresponds to the warranty on consumer goods provided by Articles 1649bis and following of the Civil Code, also known as the "conformity warranty," which protects you when products purchased by a consumer exhibit a conformity defect. This legal warranty applies to all individuals residing in the European Union.
If you experience a problem with a sold product, you can contact our Customer Service. The 2-year legal warranty applies to any conformity defect in the purchased product, specifically when:
- The characteristics of the product do not match the presented model;
- The quality and performance do not meet your expectations;
- The product cannot be used for its intended purpose or for specific functions requested.
Rights under the legal warranty of conformity: If the purchased product has a defect covered by the conformity warranty, you are entitled to have it repaired or replaced free of charge. You may also request a price reduction or contract termination in the following cases:
- If repair or replacement is impossible;
- If repair or replacement cannot be completed within a reasonable time;
- If repair or replacement causes significant inconvenience to you.
Please note that a minor defect that cannot be repaired or replaced or is excessively costly does not entitle you to terminate the contract.
Warranty period:
The legal warranty covers conformity defects appearing within two years of delivery. Retain proof of purchase. Defects appearing within six months of delivery are presumed to have existed at delivery unless proven otherwise or incompatible with the product's nature or the defect.
Article 9 - Liability
We cannot be held liable for issues or damages arising from misuse of the products. You agree to carefully read the manufacturer’s instructions included with the product, which contain important information (e.g., dosages, contraindications). Similarly, we cannot be held liable for product changes made by manufacturers.
Our liability is limited to direct damages caused by intentional fault. We are not liable for indirect damages, including consequential damages or harm to third parties. In any case, our liability is capped at the invoice amount of your order or the portion for which our liability is engaged.
We are not obliged to fulfill any obligations in the event of force majeure.
Article 10 - Right of Withdrawal
You have a 14-day withdrawal period to cancel your order without providing a reason. This period begins on the day you or a third party, other than the carrier, physically receives the product.
You must notify us of your decision to withdraw before the withdrawal period expires. You can use the withdrawal form included in the annex of these terms or contact us via the "Contact" section on our website. Refunds include delivery charges but exclude additional costs if a more expensive delivery method was chosen.
Products must be returned in new condition, in original packaging, accompanied by the delivery note and return document issued by our Customer Service. Makeup, opened perfumes, and beauty products cannot be returned for hygiene reasons.
Products returned outside the 14-day period and/or contrary to Article 10.5, as well as returns where the procedure outlined in this Article was not followed, will not be accepted or refunded. In cases of manifestly abusive and repetitive returns, we reserve the right to refuse any future orders.
You may also exercise your right of withdrawal after placing your order in accordance with the procedure outlined in Articles 10.2 and 10.3. In such cases, the refund will be issued within 14 days following the date of the order cancellation. We will send you an email to confirm the receipt of your withdrawal and the initiation of a refund request.
Article 11 - Force Majeure
We are not obliged to fulfill our obligations in the event of force majeure. In such cases, we may either suspend our obligations for the duration of the force majeure or permanently terminate the contract.
Force majeure shall include any event beyond our reasonable control, including but not limited to: natural disasters, war, riots, civil disturbances, economic sanctions, fire, floods, extreme weather conditions, explosions, epidemics, terrorism, labor disputes, strikes, lockouts, or any other form of collective action or conflict, as well as any circumstances that hinder the normal production, shipment, or transport of products, and similar situations affecting us, our subcontractors, suppliers, or carriers.
Article 12 - Privacy Protection
Your order will be processed in accordance with our Privacy Policy, which is accessible on our website and forms an integral part of these general terms and conditions of sale.
Article 13 - Intellectual Property
We grant you the right to use our website exclusively for strictly personal purposes, in accordance with the terms and conditions set forth in these general terms and conditions. You may not use our website for any other purpose, including but not limited to, personal, speculative, and/or fraudulent commercial purposes.
Our website and all texts, photos, illustrations, icons, sounds, videos, software, databases, structures, layouts, and all other data and elements of our website are protected by intellectual property rights and/or other proprietary rights. Access to and use of our website do not grant you any rights or claims to any part of our website and shall not be interpreted as a transfer or grant of a license for these rights (intellectual property or otherwise).
You may not reproduce, restore, modify, transfer, publish, adapt, or exploit the website (or any part of it) on any medium or in any manner, in whole or in part, without our prior written authorization.
The name Elevate and the Elevate logos are registered trademarks. Use of these trademarks (for purposes other than strictly personal) without our prior written consent is strictly prohibited. Similarly, when using the website and/or ordering products from third-party brands via the website, you may not reproduce, modify, adapt, exploit, or counterfeit those brands or the products ordered.
Article 14 - Complaints and Disputes
We always strive to fully satisfy our customers. If you have any complaints about our products or services, please do not hesitate to contact us at the Customer Service address (info@elevatemyskin.com) or via the contact form on our website. We will make every effort to address your complaint within five days.
All contracts concluded with our customers, regardless of their place of residence, are exclusively governed by Belgian law, and only the Belgian courts and tribunals with jurisdiction are competent to handle any disputes. If another law were to apply due to international law, priority will still be given to interpreting these general terms and conditions in accordance with Belgian legislation on market practices and consumer protection.
Article 15 - Amendments to General Terms
We reserve the right to modify or update these website terms and conditions at any time without prior notice. The current version of these terms and conditions is displayed on the website from the date the modification takes effect. In any case, the terms and conditions in force at the time of your order will apply to your purchase.
